California Privacy Rights

The California Consumer Privacy Act (CCPA) provides several rights to California residents to help them better manage and safeguard their privacy.


As a California resident you have the right to know what personal information is collected, used, disclosed and sold to others
 

How do I access my personal information?

As a California resident, you have the right to request what personal information is collected, used, disclosed and sold to others.  To request this information, go here (CCPA Request), answer the identity verification questions, and select the “Access” option under “Request Type”. 
 

How will my identity be verified?

You will be asked to verify your identity by supplying some of the same data we have on file (see data collected in the section below) so we can compare and confirm your identity.   Any information you supply will only be used for authentication purposes and will not be permanently stored or used for any other purpose.
 

What Is FocalPoint, what types of information has been collected in the last 12 months, and where was the information found?

FocalPoint is a marketing company focused exclusively on finding independent P&C insurance professionals and emailing those professionals informational and promotional materials on behalf of our clients.  Our clients are managing general agencies, program administrators and vendors who are looking to reach insurance agency professionals for the purpose of writing premium or selling agency-based services.  To accomplish this, we collect information from online sources and email interactions:

  • Online sources consist of P&C retail agency websites as well as agency and agent directory websites published by insurance carriers and agency alliances and aggregators.  The information collected is an individual’s business contact information:

    • name of the agency

    • agency’s physical or mailing address

    • agency’s website

    • agency’s fax number

    • individual’s name and job title

    • individual’s business email address

    • Individual’s business phone
       

This information is collected directly from the online publicly available source, and information is only collected for those individuals with a known email address.
 

  • Email interactions occur when an individual or their email software acts upon an email that has been received from FocalPoint.  The information collected is tied directly to an individual (i.e., the email recipient) and based on their activity:

  1. email opened

  2. email links clicked by an individual or tested by the individual’s email software
     

Why is FocalPoint collecting my data?

The data collected is used to identify and email information to those individuals who are involved in the process of obtaining insurance coverage for their customers (i.e., insureds), or are involved in their agency’s vendor selection process for operational services.  FocalPoint works with insurance industry professionals (i.e., managing general agencies, program administrators, insurance carriers, insurance wholesalers and insurance-industry vendors ) who want to promote their insurance programs and related products to these individuals via email.


Once the email is received by the individual in the agency, they can ignore, delete, or read it.   All emails are sent with traceable links.  The links take the individual to hosted material or to the client’s website where the individual can find more detailed information on the topic.  If a link is clicked, the action is interpreted as the individual being interested in the product or topic, and information associated with the link (the URL address of the link, the date and time of the click) is captured and associated with the individual.  While most activated links are done by an individual clicking, it is possible for the individual’s email software to automatically test the link, and that “test” looks and acts the same to our system as a click.  If an individual’s email software has been configured to test incoming email, it is possible that a click will be registered even though the individual did not click the link themselves.


Our clients are managing general agencies, program administrators, insurance carriers, insurance wholesalers and insurance-industry vendors.  Approximately one week after a client’s email campaign has been delivered, the client receives a report containing all of the clicks generated by their email.  The report contains all of the following information (when known) for each click:

  • name of the agency

  • first and last name of the individual

  • individual’s business email address

  • city and state where the agency is located

  • individual’s business phone number

  • electronic address of the link clicked (i.e., the link URL)

  • date the link was clicked

 

The above is the only personal information given to the client, and it is only disclosed if a link has been activated (as described above) for the specific email campaign we sent on their behalf.

 

Do you collect data on minors?

As our services are strictly business-to-business, FocalPoint does not knowingly collect, use or disclose any information for minors under the age of 16.

 

As a California resident, you also have the right to request that your personal information be deleted 


How can I get my personal information deleted?

To submit your request that we delete the personal information we have collected, go here (CCPA Request), answer the identity verification questions, and select the “Delete” option under “Request Type”.
 

Will I need to have my identity verified for this request as well?

As with any CCPA request, we must verify your identity prior to honoring your request.  You will be asked to verify your identity by supplying some of the same data we have on file (see the data captured section above) so we can compare and confirm your identity.   Any information you supply will only be used for authentication purposes and will not be permanently stored or used for any other purpose.

 

CCPA provides California Residents with the right to opt-out of the sale of their personal information

Is my information being sold, and how do I prevent that in the future?

While FocalPoint does not explicitly sell data or personal information, we do provide our clients with click-thru reports.  If you would like to request that your personal information not be included in those reports, go here (CCPA Request) and select the “Opt-Out” option under “Request Type”.  


Questions on other rights

Will there be any repercussions by FocalPoint if I choose to exercise any of my rights?

Absolutely not.  FocalPoint will not take any adverse actions or discriminate against anyone who decides to exercise any of the rights conferred to them by the CCPA.


Can I have an authorized agent make any of my requests for me?

Yes, but we are required to verify that the individual who contacts us on your behalf is indeed authorized by you to make any requests.  Authorized agents can go here (CCPA Request) and complete the form on behalf of their authorizer . 

Is there another way to exercise my CCPA rights?
